Overview
  • Alaudae Japan ("our store") is a shopping website operated by Alaudae.JP. Our store sets out below the terms of service ("these Terms") that govern the services ("the Services") available to users ("you") on our website.
Application of These Terms
  • Please read these Terms before using the Services and use them only if you agree. By using our store, you are deemed to have agreed to these Terms.

    By browsing our website or purchasing products from our store, you are deemed to have agreed to these Terms and to have used the Services accordingly. This includes the additional terms and policies referenced on this page or via hyperlinks. These Terms apply to all users of our store, including browsers, vendors, customers, merchants, and content contributors — no user is exempt.

    Please read these Terms in full before accessing or using our website. By accessing or using any part or all of the site, you are deemed to have agreed to these Terms. If you do not agree to all of these Terms, you may not access the website or use the Services. If these Terms are considered an offer, acceptance is expressly limited to these Terms.

    Any new features or tools added to our store in the future are also subject to these Terms. You can view the most current version of these Terms on this page at any time. We reserve the right to revise or change these Terms at any time without your consent. Once revised or changed, the updated Terms will be posted on the website, and you agree to be bound by them.
Language
  • Until July 2023, we offered the Services only to users in Japan. In response to strong demand from users outside Japan, we resumed the Services from March 2024 in two languages, Japanese and English. The Services are first prepared in Japanese and then translated into English using automatic translation and similar tools. The English version is provided for the convenience of users outside Japan; the base language is Japanese. Apart from differences arising from automatic translation, the Japanese and English content is the same; if there is any conflict or discrepancy between the two languages, the Japanese version prevails.
Online Store Terms
  • To agree to these Terms, you must be at least of legal age in your country of residence. Users under the age of 12 must either have a parent or legal guardian provide consent, or obtain permission from a parent or legal guardian, before agreeing to use our store. Because the definition of a minor varies by country of residence, minors must provide consent in accordance with the laws of their country of residence.

    You may not use our products for any illegal purpose, or for any purpose not permitted in your country or region of residence. You may not use the Services in violation of any laws of your country or region (including, but not limited to, copyright law). You may not transmit any worms, viruses, or other code that could damage the website. If any part or all of these Terms is breached, we may suspend the Services immediately.
General Conditions
  • We reserve the right to refuse the Services to anyone, for any reason, at any time.

    Personal data that does not include card information such as credit card numbers may be transmitted unencrypted. This may involve transmission across multiple networks and changes to conform to the technical requirements of connecting networks or devices. Credit card information, however, is always encrypted when transmitted across networks.

    You agree not to reproduce, duplicate, copy, sell, resell, or misuse any part or all of the Services. You also agree not to use or access the Services, or access the website providing the Services, in any way not authorized by us in writing.

    The headings used in these Terms are for convenience only and do not limit or otherwise affect these Terms.
Accuracy, Completeness, and Timeliness of Data
  • We accept no liability if any data made available through our store is inaccurate, incomplete, or out of date.

    Our store may contain certain historical information, which is not necessarily current and is provided for reference only. We reserve the right to change the content of this site at any time, but we are under no obligation to update the data on our site. You agree that it is your responsibility to monitor whether we have made changes to the website.
Changes to the Services and Prices
  • Product prices are subject to change without notice.

    We reserve the right to modify or discontinue the Services (or any part or content thereof) at any time without notice.

    We are not liable to you or any third party for any modification, price change, suspension, or discontinuation of the Services.
Products or Services
  • Certain products and Services are available only online through the website. These products and Services may be limited in quantity and are eligible for return or exchange only in accordance with our return policy. Note that product colors may appear different from their actual appearance depending on your viewing environment and device. We strive for accuracy, but we do not warrant that product descriptions or other content are complete, reliable, or error-free.

    We reserve the right, but are not obligated, to limit the sale of our products or Services to any individual, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We also reserve the right to limit the quantity of products or Services we offer. Product descriptions and prices are subject to change at any time without notice, at our sole discretion.

    We reserve the right to discontinue any product or Service at any time.

    Any offer of a product or Service made on our store is void where prohibited.

    We do not warrant that the quality of any products, Services, data, or other items you purchase or obtain will meet your expectations, or that any errors in the Services will be corrected. We cannot guarantee that the quality of products, Services, data, or other items will meet your expectations after purchase or receipt, nor can we guarantee the correction of errors in the Services.
Transfer of Ownership and Risk
  • Ownership of and risk for purchased products transfer to you at the time we hand the products over to the delivery carrier. For shipments that include compensation for damage or delay, if a product is lost due to the carrier's intent or negligence, we will bear responsibility for that loss in accordance with the carrier's terms. However, for shipments that do not include such compensation, we accept no liability if a product is lost due to the carrier's intent or negligence.
Cancellation, Exchange, and Return
  • We handle cancellations, exchanges, and returns according to the following conditions.

    We accept requests regarding incorrect order contents, missing items, defects, cancellations, exchanges, and returns within 30 days of product arrival. We cannot accept requests if none is submitted, so please contact us within 30 days of product arrival.

    If there is an obvious defect or shortage upon arrival, we will accept a return or exchange at our expense, including shipping and handling fees.

    For products that have not yet shipped, if you have already paid, we will honor your request and issue a refund minus the applicable fees.

    For products shipped, or returned for personal reasons, once a product has reached you — whether used or unused — we do not resell it, due to how we manage our products. Accordingly, for returns after shipping or for personal reasons, we will refund the product price minus a 30% handling fee. If you do not agree to this, we are unable to proceed.

    A product you wish to exchange must be purchased anew; we will refund the original product price minus a 30% handling fee.

Accuracy of Billing and Account Data
  • We reserve the right to refuse any order. At our discretion, we may limit or cancel purchase quantities per person, per household, or per order. These restrictions may apply to orders placed under the same user account, the same credit card, or the same billing or shipping address. If an order is changed or cancelled, we may notify you using the email address, billing address, or phone number provided at the time of the order. If we determine that an order has been placed by a dealer, reseller, or distributor, we reserve the right to limit or refuse the order at our discretion.

    You agree to provide current, complete, and accurate purchase and account data for all purchases made at our store. You also agree to promptly update your account information, email address, and other data so that we can complete transactions and contact you as needed.
Third-Party Tools
  • We may use third-party tools that we do not monitor, manage, or control.

    You acknowledge and agree that access to these tools is provided "as is" and "as available," without any warranties, representations, or conditions, and without any endorsement by us. We accept no liability arising from or related to your use of any third-party tools. Any use of tools provided through our store is entirely at your own risk and discretion. For tools provided by third parties, please use them only after understanding and agreeing to the relevant terms. We may also add new tools to the Services, and such new tools are likewise subject to the Services and these Terms.
Third-Party Links
  • Certain content, products, and Services available through our store may include links to third parties. We have no involvement in, and accept no responsibility for, the content or activities of third-party websites linked from our website. To avoid risk, please review the terms of those third parties. Any inquiries regarding third-party services should be directed to the relevant third party.
User Comments, Feedback, and Other Submissions
  • The copyright and other rights to images, text, and other materials on our store (including creative ideas, suggestions, plans, and proposals) belong to our store. With respect to the posting and use of works owned by users (rights holders), we have merely received a license from the relevant user (rights holder), and the copyright remains with that user (rights holder). However, if you provide posts or content (including creative ideas, suggestions, plans, and proposals) in connection with using the Services, you grant us a free, non-exclusive license to use that content, and you agree not to assert moral rights in connection with the Services.

    If we determine that content is illegal, offensive, threatening, defamatory, sexually explicit, or otherwise objectionable to viewers, or that it infringes any party's intellectual property, the Services, or these Terms, we may monitor, edit, or remove that content, but we are under no obligation to do so.

    You agree that your comments will not infringe any third-party rights, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You also agree that your comments will not contain defamatory, unlawful, abusive, or obscene material, and will not contain any computer virus or destructive software that could disrupt the operation of the Services or related sites. Furthermore, you agree not to use a false email address, impersonate any third party, or otherwise mislead us or third parties as to the origin of your comments. You are solely responsible for the content and accuracy of your comments. We accept no liability for any cost or damage arising from comments posted by you or any third party.

Errors, Inaccuracies, and Omissions
  • Our Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, offers, shipping charges, delivery times, and availability. We reserve the right to correct any errors or omissions, change or update data, or cancel orders at any time without prior notice (including after an order has been submitted) if any data in the Services or on related websites is inaccurate.

    Except where required by law, we are under no obligation to update, amend, or clarify data in the Services or on any related website, including pricing data. We are also under no obligation to provide individual notice of any changes or updates to data in the Services or on related websites.
Prohibited Uses
  • In addition to the other prohibitions set out in the Services and these Terms, we prohibit the use of content for the following purposes:
    • Any unlawful purpose.
    • To cause others to commit, or to solicit participation in, any unlawful act.
    • To violate any international, federal, provincial, state, or local regulation, rule, law, or ordinance.
    • To infringe the intellectual property rights of our store or any third party.
    • To harass, abuse, insult, defame, slander, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, national origin, disability, or similar characteristics.
    • To submit false or misleading data.
    • To upload or transmit viruses or other malicious code that may disrupt the functionality or operation of the Services, related websites, third-party websites, or the internet.
    • To collect or track the personal data of others.
    • To spam, phish, pharm, defraud, spider, crawl, or scrape.
    • For any obscene or immoral purpose.
    • To interfere with or circumvent the security features of the Services, related websites, third-party websites, or the internet.

    We reserve the right to suspend your use of the Services and related websites for any violation of these prohibitions.
Exclusion of Antisocial Forces
  • You represent and warrant that you do not, and will not in the future, fall under any of the following:
    • An organized crime group (boryokudan).
    • A member of an organized crime group.
    • A quasi-member of an organized crime group.
    • An organization related to an organized crime group.
    • A corporate racketeer, a group engaging in criminal activities under the guise of social or political activities, or a group with special intelligence-based violence.
    • A person with a social or economic relationship with any of the above.

    You further warrant that you will not, by yourself or through a third party, engage in any of the following:
    • Violent demands.
    • Unreasonable demands beyond legal responsibility.
    • Damaging another party's credit or obstructing its business through deception or force in connection with transactions.
    • Any other act equivalent to the above.

    If it becomes clear that you fall under, or have engaged in conduct falling under, any of the above, or that you have made a false declaration regarding these Terms, we reserve the right to refuse to provide the Services to you.
Disclaimer of Warranties; Limitation of Liability
  • We do not represent or warrant that your use of the Services will be uninterrupted, timely, error-free, or secure.

    We do not warrant that the results obtained from using the Services will be accurate or reliable.

    You agree that we may, without notice, suspend or remove the Services indefinitely, or cancel the Services, at any time.

    You expressly agree that your use of, or inability to use, the Services is at your own risk. Except where expressly stated by us, the Services and all products and services provided through them are provided "as is" and "as available" for your use, without any representation, warranty, or condition of any kind, whether express or implied. This includes any implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

    In no event shall our store's directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable — whether in contract or tort (including negligence) — for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages (including, but not limited to, lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages). We are also not liable for any other claim arising from or related to your use of the Services or any product obtained through them (including any loss or damage resulting from the use of content or products posted, transmitted, or otherwise made available through the Services), even if advised of the possibility of such damage. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions our liability is limited to the maximum extent permitted by law.
Indemnification
  • You agree to indemnify, defend, and hold harmless our store and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand (including reasonable attorneys' fees) made by any third party arising from your breach of these Terms (including documents incorporated by reference) or your violation of any law or the rights of a third party. For damages or losses caused to you by our intent or gross negligence, our liability is capped at the amount we received from you.
Severability
  • If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such severance does not affect the validity or enforceability of the remaining provisions.
Termination
  • The obligations and liabilities of both parties incurred before the termination date survive termination of these Terms for all purposes.

    These Terms remain in effect unless terminated by you or us. If you no longer wish to use the Services or wish to discontinue them, you may terminate your use of the Services at any time by contacting us.

    If we determine that you have breached, or are suspected of breaching, any provision of these Terms, we may terminate these Terms at any time without notice. In that case, you remain liable for all amounts due up to and including the date of termination, and we may deny you access to the Services (or any part thereof).
Entire Agreement
  • Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

    These Terms, together with any policies or operating rules regarding the Services posted by us on the website, constitute the entire agreement and understanding between you and us regarding your use of the Services, and supersede any prior or contemporaneous agreements, communications, or proposals (whether oral or written, including prior versions of these Terms) between you and us.

    Any ambiguity in the interpretation of these Terms shall not be construed against the party that drafted them.

  • You can review the most current version of these Terms on this page at any time.

    We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Services after changes to these Terms are posted constitutes acceptance of those changes.
Governing Law and Jurisdiction
  • These Terms are governed by the laws of Japan. For any dispute arising between you and us in connection with our product sales or the Services, the district court or summary court having jurisdiction over the location of our store shall be the exclusive court of first instance by agreement.
